So far as Sri.PC George is not taking two salaries as of MLA and Minister, by virtue of his cabinet rank as chief whip, the case of office of profit under art.191 of constitution will not stand. Ministers are exempted from this disqualification by constitution. The contention of adv,Sebastian Paul is that state hqs not enacted exemption for chief whip and opposition leader. So far as they are having cabinet rank, they are equal to ministers whatever nomenclature with which they are called be and the exemption for ministers will be applicable to them
Art.191 and 101 are prohibiting MLAs and MPs from enjoying office of profit under state and central governments. Cabinet rank is bestowed by government itself and salary will be restricted to one office only. Further the only authority to decide the case is governor and president as per art.192.so the complaint to election commission is out of place.
